Functions:

  • To prepare and implement the regulatory basis of the Budgetary Unit based on its mission and in compliance with the legislation in force in the country that corresponds to it by law.
  • To direct and guide the actions of the different areas of the Budgetary Unit for the efficient fulfillment of the assigned missions.
  • Plan, accumulate, store, rotate, maintain, preserve and respond for the physical integrity, quality and control of food and material reserves for contingencies.
  • To guarantee that the main productions and services it develops are carried out in accordance with what has been approved in its corporate purpose.
  • To establish the functions and duty to be developed by each level of management in the Budgetary Unit in accordance with the established structure and to select the appropriate personnel to carry them out.
  • Organize and control the security and physical protection system, plan the measures to be taken in order to preserve the school's equipment, means, materials and information.
  • Organize the process of preparing the annual budget of the school in all its categories, break it down by month and control its execution.
  • Prepare the Budget Unit's accounting manual and ensure its correct application.
  • Prepare and implement the procedure for the economic and workforce recruitment of the Unit.
  • To periodically issue the financial statements in accordance with the established requirements in terms of time, quality and veracity.
  • Assess the financial ratios obtained in the management of the unit and ensure that the necessary measures are in place to eradicate deviations.
  • Design and implement the internal control system based on current legislation.
  • To guarantee, according to the provisions of each case, the payment of the corresponding taxes of the Budgetary Unit in time and form.

Functions:

  • To comply and control the activity in charge of the Ministry of the dispositions dictated by the Global Organisms of the Economy in 10 referring to the planning of the Technical Material Supply and the Investments.
  • To prepare the demand for those Material and Energy Resources that maintain their allocation through the State Governing Office. Assigns and disaggregates the figures to the System of National Institutions; organizes and controls the use and destination of these resources.
  • Issue the Methodological Instructions related to the Technical Material Supply and Investments and carry out the supervision and control to the Institutes, Councils and other Entities of National subordination, establishing the corresponding relations to such effects with the Economy Directorate.
  • To participate systematically in the Foreign Exchange Commission of the Ministry of Culture for the analysis of the economic management of the Business System and Self-financing Schemes of Culture.
  • To dispose of the flow of property (Basic Means) belonging to the National Subordination System, keeping it updated.
  • Indicate when it is decided that the corresponding transfers and movements will be executed.
  • Evaluate, propose to the Minister of Culture and control the application of the System of Compensation of private cars according to the work in our Institutions of National Subordination; maintain the System updated according to the established rules and regulations.
  • Exercise control over compliance with the Regulations and Standards established for the Warehouse Economy in all the Departments of the Ministry of Culture.
  • To advise the System of National and Territorial Institutions in the acquisition of the Basic Technical Means for the development and execution of cultural activities, seeking the best purchase conditions and ensuring the most appropriate technical-economic selection.
  • Advise and assist methodologically the Technical Services of the Territories in the technological aspects associated with the Technical Material Base of Culture.
  • To attend methodologically and to control the activities related to the ANIR, BTJ and Forum of Science and Technique, evaluating and generalizing the results.
  • To process within the System of Culture the requests of licenses and patents. (This should be passed on to the Juan Marinello Center).
  • To guarantee the effective implementation of the regulations in force for the operation and control of the Automotive Equipment. Inspect and control the organization and exploitation of said Equipment in the Ministry of Culture's Offices.
  • Exercise the governing function of the Investment Process, in the whole System of Culture and Art, controlling the Working Guidelines that comply with the State Policy and the Ministry of Culture.
  • To guide and methodologically direct the work of the Ministry's departments and the Provincial Directorates in everything related to the Investment Process.
  • Instruments and controls the National Energy Saving Programme and controls the energy increases derived from new investments.

Functions:

  • Advising the main heads in the compliance with the legal and regulatory basis by organizing the management and control of the safety and protection system in the Ministry of Culture.
  • To comply with and develop an information system to provide timely, accurate and truthful information to the management of the Ministry of Culture and the Protection Directorate of MININT.
  • Approve or direct the good of the process of selection, preparation and professional improvement of Heads of Protection, Technicians and Specialists and the rest of the personnel who occupy levels of the specialty as well as workers and students who fulfill all the tasks of the Security and Protection System.
  • Overall development in the office the analysis and planning of the budget for investments in the security and protection system.
  • Representing by delegation the highest authority of MINCULT before the operational lines of MININT and complying with the ministerial indications to participate in the measures that can guarantee events of national and international, political, scientific, sports or cultural character.
  • Advise the main leaders of the agency on security and protection matters and propose measures, organizational forms and tasks to solve deficiencies and irregularities detected in government controls, in MININT visits and inspections and in the control and assistance activities themselves.
  • Organize the control system in companies and agencies contracted to provide security and protection services in their area of competence and identify deficiencies and irregularities and report them to the Ministry of Culture.
  • Adapt to the characteristics of the Ministry of Culture the annual work guidelines and objectives established by the Directorate of Protection of MININT, ensuring compliance.
  • Organize the systematic evaluation of the effectiveness of the security and protection system by means of computer audits and checklists of the specialty, determining the threats and risks to which the objectives may be subject, evaluating and proposing the necessary measures to establish the integrity of the system.
  • Advise, direct and control the operation of the fire protection system and the training of personnel working in places or areas exposed to risk, keeping the Directorate of the Ministry informed of the existing situation and the measures deriving from the stable inspections and controls carried out by the inspections of that office.
  • It carries out the methodological direction of the Security and Protection activity at all levels and entities of culture, including its Security and Protection Company.
  • By delegation, it directs the Security and Protection System with all its Specialties to be known:
    • Physical Protection.
    • Protection of Official Information.
    • Computer Security.
    • Control of industrial explosives, their chemical precursors, ammunition, chemical, explosive or toxic substances.

As established in Article 39 of Decree Law 186/98.

  • Organize the systematic evaluation of the effectiveness of the security and protection system by means of computer audits and checklists of the specialty, determining the threats and risks to which the objectives may be subject, evaluating and proposing the necessary measures to establish the integrity of the system.
  • Advise, direct and control the operation of the fire protection system and the training of personnel working in places or areas exposed to risk, keeping the Directorate of the Ministry informed of the existing situation and the measures deriving from the stable inspections and controls carried out by the inspections of that section.

 

Functions:

  • To advise the Minister and the leaders and officials of the Ministry of Culture, in matters of a legal nature, related to the activities carried out by the office.
  • To comply with and monitor compliance with the legal regulations, in the office system.
  • To make consultations and issue opinions on the legality of documents, claims, complaints and appeals submitted for their consideration, related to the activities carried out by the organization.
  • To study the regulations, projects and legal documents and to inform at a higher level about their implications for the body, its cultural institutions, centres and other departments, and to propose, where appropriate, the measures it considers appropriate.
  • To contribute to the fact that regulations, resolutions, instructions and other documents of a normative nature are issued within the limits of the respective competences and that socialist legality is observed in this.
  • To give its opinion on draft laws, decree-laws, decrees, regulations and other legal provisions submitted for consideration by the office;
  • To prepare draft laws, decree-laws, decrees, regulations and other legal provisions of interest for the better development of the activities of the organization, its cultural institutions, centers and other departments.
  • To register, preserve and, if necessary, process the legal documents drawn up by the organization, as well as to issue the required certifications.
  • Legalize the signatures of the main leaders and officials in order to be accredited in its relations with other national entities, and process them through the Ministry of Foreign Affairs, when required, depending on the relations with other countries or international entities;
  • Participate in negotiations for the signing of intergovernmental agreements and conventions, in which the Cuban party is represented by the Ministry of Culture, as well as in trade negotiations, which, due to their importance for the country, are directly handled by the office;
  • Attend to consultations, advise and assist in the drafting and preparation of conventions, agreements and other documents deriving from international trade relations, both at government level and with commercial entities directly;
  • Act as legal representative of the organization before other national or foreign entities;
  • Acting on behalf of the Ministry of Culture, or any of its cultural institutions, when so decided, in criminal, civil, administrative, labor, economic and national and international arbitration proceedings where appropriate, or their leaders, when dealing with matters relating to the functions of their respective positions;
  • Propose measures to contribute to the development of legal awareness and culture among the staff of the agency's system;
  • To draw up or give an opinion on contracts and pro formas of contracts, in cases where the Ministry of Culture is a party;
  • Participate in working groups, events and others of a similar nature sponsored by international organizations and agencies, linked to legal matters related to culture;
  • Representing the Ministry of Culture before commissions and participating in working groups that, due to the nature of the matter, are within the competence of the Ministry;
  • To study and give an opinion, from the legal point of view, on the operations to be submitted to the Contracting Committee;
  • Promote, systematize and keep updated the legal provisions, national or foreign, related to the system of the organization or to the activity under its responsibility, including the texts of treaties, conventions, protocols and other documents that imply obligations or rights of the organization, as well as keep updated, in the subject of their specialty, the jurists of the entities of the system of the organization;
  • To advise the minister and the authorized leaders on the application of disciplinary corrective measures to leaders, officials and workers;
  • Systematically analyze the legal norms in force, related to the activity carried out by the Ministry of Culture, proposing to the corresponding higher management level, the modifications that they consider appropriate;
  • To provide legal advice to lawyers and organizational units of the institutions, companies and entities attached to the Ministry, guiding the work of legal advisors methodologically, assisting them in any branch of law; contributing to administrative efficiency and contractual discipline on which business management is based and maintaining supervision and control of the work of its legal advisors.

Functions:

  • The State Inspectorate of the Ministry of Culture controls in all SLAs the compliance with the regulations, checks and evaluates the activities in the different spheres of work and at all levels of management including the functioning of the entities that are subordinated to it.
  • Implementing Decree 226 on Personal Violations of the Regulations on the Provision of Artistic Services, and other provisions relating to the provision of cultural services.
  • To inspect the existence, the degree of conservation and use of the material base of study and life in the Schools of Art, and the resources allocated by the management of the country to the cultural institutions of the territory.
  • Ensure cultural programming in institutions, provinces and municipalities, with emphasis on weekend and evening activities.
  • To work jointly with the Directorate of the Ministry of Culture on events, behaviour or complaints involving alleged violations of the code of ethics, at the request of the Directorate of the Ministry of Culture.
  • Check the development of other activities and tasks that constitute defined objectives for the implementation of cultural policy.
  • To integrate the Provincial Commissions for the Prevention of Illegalities of the Governments in each territory, in order to carry out joint inspections to contain the illegalities associated with the sector (self-employed booksellers, private galleries, illegal video banks, record piracy, etc.)
  • Surprise inspections to verify compliance with plans for the prevention of corruption, illegalities and indiscipline in Art Schools and in all Institutions and Entities covered by the Ministry of Culture.
  • Carry out surprise inspections of prevention plans for the abuse of narcotic drugs.
  • Check and control the work of the provincial departments throughout the country that form the Inspection System of the Ministry of Culture including the Isle of Youth.
  • Participate in the Integral Controls planned by the Ministry.
  • Carry out Management Inspections of subordinate entities in order to supervise the application of Resolution 297 on internal control. (New modality of work in the Inspectorate included, indicated by the Directorate of the Ministry already tempered to the demand for greater control for all spheres of the sector).
  • This Directorate also organizes, plans and represents the Ministry, in the Government Controls led by the Ministry of Audit and Control.

Functions:

  • To guide methodologically, advise, and control the execution of the policy of development of the leaders in the organism.
  • To support the main leaders in all aspects related to the application of this work system that has the objective of providing the heads with the necessary elements for decision making.
  • To maintain an active and permanent link with the leaders and groups of management of the system.
  • Arrange for the Executive Secretariat of the agency's Committee on Managers to advise and provide the necessary elements to be adopted for collective decision-making on work with managers and their reserves.
  • To guarantee that the selection and movements of leaders are carried out with the required quality in accordance with the nomenclature of positions and levels established by the Cuban Communist Party and the Executive Committee of the Council of Ministers, which is specified annually.
  • To advise the subordinate workers on how to carry out the process of selecting leaders and their reserves, with high rigour and maximum quality, ensuring the appropriate combination of the most experienced leaders with the youngest ones, as well as the promotion of young people, women and black people to leadership positions.
  • To ensure strict compliance and quality in the organization of the processes of delivery and reception of the position in the institutional system and to participate in the delivery and reception of the leaders of the nomenclature of the Minister of Culture.
  • Coordinating with the Legal Directorate the legalization of all actions required with the leaders and with legal advice at the appropriate level, any disciplinary proceedings initiated, monitoring the cases of cadres who have been subject to disciplinary measures and the periods of rehabilitation in each case.
  • Monitor information and carry out investigations into complaints from workers and the public in which the leaders have an impact.
  • Advise the management of the agency in establishing the branch strategy and coordinating the annual training plans for leaders and their reserves.
  • Coordinate with the National Centre for Overcoming Handicaps, the Higher Institute of Art and other authorised departments, the ways and means of preparing and overcoming handicaps for leaders and reserves, in accordance with their needs and those of the management groups.
  • Establish links with other sections of the Central State Administration and training centres for the better implementation of the policy on leaders in the country.
  • To organize all the methodological control activity carried out by the Ministry to the national institutions and the territories regarding the policy of leaders.
  • Control, consolidate and analyze the information referred to the composition, characteristics and work actions with the leaders and their reserves that allow the establishment of work policies in the organization.
  • Carry out studies on human resources problems that have an impact on the policy for leaders, coordinating with the corresponding Directorate.
  • Promote and monitor the dissemination, knowledge, compliance and correct application of the Code of Ethics for Cuban State Managers in management groups.
  • It is responsible for the general organization, guidance, advice and supervision of the evaluation process of the Ministry's staff.
  • Promote, organize and/or encourage the execution of actions to stimulate the leaders of the institutional system.
  • Agreeing with the appropriate sections of the Ministry of Public Health on medical and dental check-ups for the Ministry's first-level leaders and reserves and ensuring that they are carried out in all institutions.
  • To safeguard documentation on the careers of staff and the monitoring of all actions carried out with them, and to ensure that this is done in the staff units of the institutions in accordance with the established nomenclature and the requirements of State secrecy.
  • Support the introduction into the institutional system of a culture of the contributions of management science, automation and information technology, as well as new experiences in the work of the country's policy on leaders.
  • By delegation of the Minister, process and control the authorization of the personal departure from the country of university professionals working in the institutional system of culture.
  • To know, process and issue criteria on proposals for the awarding of state decorations in the cultural sector. To keep the register of decorated personalities and groups up to date; to coordinate the appropriate form and timing for the granting of the corresponding incentives.
